The terms that apply when using TidalFlow Tech websites, applications and related software services.
1. About these terms
These terms apply to applications and services developed or operated by TidalFlow Tech, including business management, sales, merchandising, attendance, delivery, reporting and point-of-sale applications.
Some organisations may have an additional service agreement, subscription agreement, implementation agreement or data processing agreement with TidalFlow Tech. Where such an agreement applies, its terms may supplement these general terms.
2. Account registration and authentication
To use certain application features, you may be required to create or receive a user account. During account creation and use, we may collect and process information including:
- Your email address.
- Your authentication credentials, including your password.
- Your full name.
- Your telephone number.
- Your company, branch, outlet, role or staff information.
Your email address and authentication credentials are used to verify your identity, sign you into the application, protect your account and control access to authorised application features.
Your name, telephone number and related profile information are used for account management, user identification, communication, support and administration within your organisation.
You are responsible for keeping your login credentials confidential. You must not share your password with unauthorised persons or allow another person to use your account.
3. User-generated information and images
Our applications may allow users to create, upload, capture or submit information, documents, photographs and other content. This may include:
- Product and merchandising photographs.
- Outlet, shelf, display and stock photographs.
- Profile images.
- Receipts, invoices and supporting documents.
- Sales, attendance, delivery and activity records.
- Notes, comments and other information entered by users.
User-generated images and information are collected and stored so that the application can provide its intended features, maintain business records, support reporting and allow authorised users to review completed work.
You must only upload content that you are authorised to use. You must not upload unlawful, misleading, offensive, confidential or infringing content.
You retain ownership of content you submit. You grant TidalFlow Tech permission to host, process, transmit, display and back up that content only as reasonably necessary to operate, secure, maintain and improve the application.
4. Location information
Some TidalFlow Tech applications may request access to the location of your device. Location information is particularly important for the correct operation of the TidalFlow merchandising application and other field-based services.
Depending on the features enabled by your organisation, location information may be used to:
- Confirm visits to assigned outlets or work locations.
- Record where a merchandising activity was completed.
- Support attendance, check-in and check-out functionality.
- Validate field activity and delivery records.
- Improve route, outlet and territory visibility.
- Protect the accuracy and integrity of business reports.
Location access is only used for application functionality, operational verification, reporting and authorised business administration. Some location-dependent features may not work correctly when device location permissions are disabled.
Your organisation may determine which location features are enabled and which authorised managers or administrators may view location-related records.
5. Device permissions
Depending on the application and the features you use, the application may request permission to access certain device capabilities, including:
- Camera access for capturing images and documents.
- Photo or file access for uploading existing content.
- Location access for field and merchandising activities.
- Notification access for alerts and account updates.
- Internet access for synchronising application data.
These permissions are requested to enable the relevant application features. You may manage permissions through your device settings, although disabling a required permission may prevent some application functions from operating correctly.
6. How application data is used
Information collected through our applications may be used to:
- Create, authenticate and manage user accounts.
- Provide the features requested by users and organisations.
- Store sales, stock, attendance and operational records.
- Generate reports, dashboards and business insights.
- Provide customer support and resolve technical problems.
- Send service, security and account notifications.
- Detect misuse, fraud, unauthorised access or security threats.
- Maintain, troubleshoot and improve application performance.
- Comply with applicable legal and regulatory requirements.
We do not use application data for purposes that are unrelated to providing, securing, administering or improving our services unless we have a lawful reason or the required consent.
7. Data access within organisations
When your account is connected to an employer, customer, company, branch, outlet or other organisation, authorised administrators from that organisation may be able to access information created through your account.
This may include your profile information, work activity, photographs, attendance records, location-related activity, sales records, assigned tasks and application usage information.
Your organisation is responsible for determining which users are authorised to access its business information and for managing staff access according to its internal policies.
8. Data security
Data transmitted between supported applications, your device and our online services is encrypted while in transit using appropriate secure communication technologies.
We also use reasonable technical and organisational safeguards designed to protect application information against unauthorised access, loss, misuse, alteration or disclosure.
No electronic system can be guaranteed to be completely secure. Users must protect their accounts, use strong passwords, keep devices secure and report suspected unauthorised access promptly.
9. Data storage and retention
Application information may be stored for as long as necessary to provide the service, maintain business and financial records, support the organisation using the application, resolve disputes, enforce agreements and comply with legal obligations.
The applicable retention period may depend on the application, the type of record, the organisation using the service and any contractual or legal requirements.
When information is no longer required, it may be deleted, anonymised or securely archived in accordance with applicable requirements and operational policies.
10. Third-party services
Our applications may rely on trusted third-party service providers for functions such as authentication, cloud hosting, database storage, notifications, mapping, error monitoring, email delivery and payment processing.
These providers may process limited information as necessary to deliver their services. Their handling of information may also be governed by their own terms and privacy policies.
11. Acceptable use
You agree not to:
- Use an application for unlawful or fraudulent activity.
- Access another person's account without permission.
- Provide false or misleading account or operational data.
- Manipulate location, attendance or field activity records.
- Upload harmful, unlawful or unauthorised content.
- Introduce malware or attempt to disrupt an application.
- Attempt to bypass security or access controls.
- Copy, reverse engineer or misuse protected software.
- Use automated methods to extract data without permission.
- Interfere with the availability or performance of the service.
12. Application availability and updates
We aim to keep our applications available and functioning correctly, but we do not guarantee uninterrupted or error-free operation.
Applications may occasionally be unavailable because of maintenance, updates, network problems, device limitations, third-party service interruptions or circumstances outside our reasonable control.
We may update, add, remove or modify application features to improve security, performance, usability or compliance.
13. Suspension and termination
Access to an application may be suspended or terminated where:
- You violate these terms.
- Your organisation disables or removes your account.
- A subscription or service agreement ends.
- Access presents a security or operational risk.
- Suspension is required by law or a competent authority.
You may stop using the application at any time. Account deletion and data removal requests may be subject to organisational, contractual, financial recordkeeping or legal requirements.
14. Intellectual property
TidalFlow Tech applications, software, designs, interfaces, branding, documentation and related materials are owned by or licensed to TidalFlow Tech.
These terms grant you a limited, non-exclusive and revocable right to use the applications for their intended business purpose. They do not transfer ownership of the applications or their underlying technology to you.
15. Limitation of responsibility
Users and organisations remain responsible for reviewing the accuracy of information entered into the applications and for making their own operational, financial and business decisions.
To the extent permitted by applicable law, TidalFlow Tech will not be responsible for losses caused by inaccurate user entries, unauthorised account access resulting from compromised credentials, unsupported devices, internet failures, third-party service interruptions or use of an application outside its intended purpose.
16. Changes to these terms
We may update these terms when our applications, business practices, security measures or legal obligations change.
The latest version will be published on this page with an updated effective date. Continued use of our applications after an update means that the revised terms will apply from their effective date.
